This website (“Site”) is owned and operated by Willer Enterprises, an Australian sole-trader business operating under a registered ABN (available upon request for verified legal purposes).

Willer Enterprises functions as an independent umbrella brand developing and managing multiple ventures and sub-brands, including Willer Wicks, Willer Hub, and other projects (“Brands”).

By using this Site, purchasing any product, or participating in any service or program operated by Willer Enterprises or its Brands, you agree to these Terms and Conditions, Refund Policy, and Privacy Statement (collectively “Terms”).
If you do not agree, please discontinue use of the Site.

Scope of Business

Willer Enterprises is a creative and commercial brand group engaged in product design, digital media, content creation, e-commerce, and marketplace ventures.
Each Brand (e.g. Willer Wicks or Willer Hub) may have its own supplementary policies which apply alongside these Terms.

Orders and Payments

Payments are processed through Square, which automatically converts international currencies into AUD.
Full payment is required at checkout. Orders are confirmed only once payment clears.

Willer Enterprises may:

Cancel or refuse any order suspected of fraud, abuse, or error;
Correct typographical or pricing errors;
Restrict bulk, resale, or exploitative purchases.

Initiating an unjustified chargeback (disputing a legitimate payment) constitutes a breach of these Terms.
All chargebacks will be contested with documented evidence, and any related losses may be recovered.

Acceptance of Terms: By ticking the agreement box at checkout, you confirm you have read and accepted these Terms. The record of that confirmation is stored with your order.

Shipping and Fulfilment

Physical goods (where applicable) are shipped worldwide using a range of couriers to achieve the best balance of speed and cost.
Orders are typically dispatched within two (2) business days of order confirmation.

Risk passes to the customer when goods are handed to the courier.
Title (ownership) transfers once payment has been received in full.

We may assist in courier or insurance claims but are not the contracting party with the courier.
Customs duties or import taxes (if any) are the buyer’s responsibility.
We are not liable for customs delays, courier errors, or events outside our control.

Refunds, Returns, and Claims

There are no refunds or exchanges for change-of-mind purchases.
Refunds or replacements will only be issued as required under the Australian Consumer Law (ACL) — for example, where an item is faulty, unsafe, or not as described.

Your rights under the ACL are not limited or excluded by these Terms.
Depending on the situation, remedies may include repair, replacement, or refund.

Custom or made-to-order items cannot be returned except as required by law.
All claims must be made within seven (7) days of receiving the order through the contact form on this Site, including photos and a brief description of the issue.

We will acknowledge all claims within three (3) business days and resolve them within fourteen (14) business days of acknowledgement.
Customers are responsible for return postage unless otherwise required by law.

Product and Service Use

All products and services must be used only as intended.
Willer Enterprises accepts no liability for injury, damage, or loss arising from misuse, negligence, or failure to follow any product or service guidelines.

Willer Hub

Willer Hub, operated by Willer Enterprises, is a creator and founder participation system.
Hub members operate under separate terms supplied to and accepted by them upon joining.
Those specific Hub terms apply in addition to this Legal page.

Intellectual Property

All names, logos, text, product designs, images, videos, and other content on this Site are owned or licensed by Willer Enterprises.
You may not reproduce, redistribute, or commercially exploit any part of this Site or its content without written permission.

Unauthorised use, resale, or reproduction of Willer-branded materials may lead to legal action and recovery of damages.

Defamation and Misrepresentation

Making or publishing false or malicious statements about Willer Enterprises, its Brands, products, or representatives (including on social media or reviews) that cause or are likely to cause serious harm to reputation may result in legal proceedings under the Defamation Act 2005 (NSW).

Before any legal action is considered, Willer Enterprises will provide written notice identifying the allegedly false content and allow a reasonable opportunity to correct or retract it.

We reserve the right to pursue remedies for proven malicious or defamatory conduct resulting in financial or reputational harm.

Website Use and Conduct

You must not:

Use the Site for unlawful, fraudulent, or disruptive purposes;
Interfere with Site security or attempt unauthorised access;
Copy, scrape, or reproduce Site content;
Submit false orders or spam messages.

Violation of these rules may result in restricted access, order cancellation, or legal action.

Limitation of Liability

To the fullest extent permitted by law, Willer Enterprises is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, data, goodwill, or opportunity.

Subject to the ACL, the total liability of Willer Enterprises for any claim arising from a product or service is limited to the greater of:

The purchase price paid for the relevant item; or
AUD $5,000.

Nothing in these Terms removes rights guaranteed by the Australian Consumer Law.

Indemnity

You agree to indemnify and hold harmless Willer Enterprises, its owners, and affiliates against all losses, damages, liabilities, and expenses arising from:

Your breach of these Terms;
Misuse of Site content or products; or
Any unlawful activity conducted through or in connection with your use of the Site.

Force Majeure

Willer Enterprises is not responsible for delays or failures to perform obligations under these Terms due to events beyond reasonable control — including natural disasters, transport failures, strikes, pandemics, or government restrictions.
Obligations are suspended for the duration of the event and will resume once normal operations can continue.

Privacy Statement

Willer Enterprises collects only the information necessary to process orders, operate programs, and maintain communication.
This may include your name, contact details, and transaction history.

Data may be shared with trusted third parties (such as payment processors, couriers, or analytics services) solely for operational purposes.
We do not sell, rent, or disclose personal information outside of these uses.

You may request to access, correct, or delete your personal data through the contact form.
All data is stored securely and handled in compliance with Australian privacy principles.
A separate Privacy Policy will be published when data collection expands or changes.

Dispute Resolution

Before initiating external complaints, customers must first contact Willer Enterprises through the Site contact form to allow internal review.
We aim to acknowledge disputes within three (3) business days and provide a resolution within fourteen (14) business days.

If a resolution cannot be reached, disputes will be handled under the laws and courts of New South Wales, Australia.

Standard Legal Clauses

Severability: If any part of these Terms is found invalid, the remaining provisions continue in effect.
Waiver: Failure to enforce a right does not waive it.
Entire Agreement: These Terms form the complete agreement between Willer Enterprises and the user, overriding any prior discussions or understandings.
Assignment: Willer Enterprises may assign or transfer its rights under these Terms without notice.
Survival: Clauses relating to intellectual property, limitation of liability, and indemnity survive termination of this agreement.

Governing Law

These Terms are governed by the laws of New South Wales, Australia.
For international transactions, these Terms remain governed by NSW law, and disputes shall be resolved exclusively in the courts of New South Wales.
